Abstract

The European Small Claims Procedure has been designed to simplify and speed up cross-border litigation. The article analyzes EU and national jurisprudence. Since the number of judgments available in public databases is modest, the discussion has been enriched with the conclusions drawn from interviews with advocates and legal counsellors who have practical experience in cross-border enforcement cases. Due to the many advantages of the discussed procedure, emphasized in the paper, author’s own conclusions as to its functioning have been formulated.
