Abstract
The commented judgement refers to two legal problems arising in the context of bankruptcy and Actio Pauliana. The former relates to the issue of determining a proper way to claim ineffectiveness of a legal act with respect to a third person that has the status of a bankrupt. In this regard, it is possible to assume that the proper way of asserting claims is to bring an action or to submit a claim to the judge-commissioner. The latter issue concerns the action relating to property that is part of the bankruptcy estate and at the same time the claim contained therein needs to be reported to the judge-commissioner. It is necessary to indicate which decision should be taken in relation to the action.
