Data protection officer versus peremptory decisions of the supervisory authority in individual cases

Abstract

The article presents the legal situation the a data protection officer (DPO) in relation to the supervisory authority. The DPO is assigned to cooperate with the supervisory authority, perform the function of a contact as regards issues associated with personal data protection. On the other hand, the DPO is obliged to support the controller or the processor as regards the implementation of those duties. The problem is to reconcile those two types of duties when the supervisory authority issues peremptory decisions in individual cases. The article analyses material and procedural issues in this respect.
