Abstract
The article deals with the issue of grading the degrees of probability of an offence having been committed in criminal proceedings. In particular, the Author presents the problem in the context of selection mechanisms in criminal proceedings. She bases her deliberations on the provisions of Art. 307 of the Code of Criminal Procedure. In the article, she analyses the institution of checks in terms of its selective nature, and also addresses the question of the degree of probability in which carrying out the checking procedure is possible. The Author pays attention to the question of a justified presumption that an offence has been committed and assessment of its occurrence on the so-called foreground of criminal proceedings.
