Abstract

The article deals with the issue of grading the degrees of probability that a criminal offence has been committed in criminal proceedings. In particular, the Author presents that problem in the context of selection mechanisms in criminal procedure. She discusses those issues on the basis of Art. 307 of the Code of Criminal Procedure. In the article, she analyses the verification procedure in terms of its selective character, including the question of the degree of probability to the extent of which the verification procedure is possible. The Author pays attention to the question of a justified suspicion that an offence has been committed and assessment of its occurrence before criminal proceedings have been initiated.
