Abstract

The article questions the view presented in Polish jurisprudence that a representative is a party to legal transactions effected by him on someone else’s behalf. This view does not correspond with the theory of representation, which underlies the provisions of the Polish Civil Code concerning representation. It is in conflict not only with the provisions on representation, but also other provisions on parties to legal transactions.
