Abstract

The article presents the problem of mortgage loans denominated in Swiss francs from two perspectives. First, the perspective of unfair terms, and secondly - the Polish Supreme Court judgments. In other words, it has been analysed what is the position of the Supreme Court with reference to each of the unfair terms criteria in the context of such loans. It has also been considered whether finding an indexing clause abusive may lead to the annulment of a contract, and, if yes, what are the consequences of such annulment.
