Abstract
Connected and autonomous cars are becoming increasingly popular. They provide access to new functionalities, but also generate large amounts of data. Consultations on the draft EDPB Guidelines for the processing of personal data in connected cars were completed in May 2020. The Guidelines raise doubts e.g. regarding treatment of the connected car as an end device and the requirement of granting consent for the storage of and access to the collected data. The approach to notifying data processing also needs to be verified. In addition, the implementation of the European Electronic Communications Code is approaching. The draft of Electronic Communications Act addresses the issues of machine to machine („M2M”) communication used in such vehicles. Providers of data transmission services used for M2M will be subject to the new regulations only if their services are publicly available. Services provided to dedicated users will not be subject to the new regime.
