Abstract
The article discusses effectiveness of court decisions establishing a system of separate properties in matrimony. It also presents the impact of a declaration of bankruptcy on effectiveness of court decisions establishing a system of separate properties. Establishing a system of separate properties not only ends the esistence of the joint marital property as of the date designated in the judgment establishing a system of separate properties, but also affects admissibility and effectiveness of the division of joint property. Therefore, on the basis of the case law of the Supreme Court, the effectiveness of the division of a joint property as a result of the termination of the joint property regime by virtue of law or conclusion of a post-nuptial agreement in the case of subsequent establishment by a court judgment of a system of separate properties before the date of the division and the effectiveness of the division of a joint property before a court judgment on a system of separate properties have been discussed.
