Abstract

The publication discusses the consequences of repealing resolutions of the National Bailiff Council and the authorities of bailiff chambers by the Supreme Court. The paper discusses the legal nature of resolutions of bailiff self–government bodies and presents the relation of Art. 215.1 of the Act on Court Bailiffs to Art. 58 § 1 and § 2 of the Civil Code. The author is in favour of a construction under which resolutions of bailiff self–government bodies that are against the law should be qualified within the framework of the institution of relative nullity.
