Abstract

As of 1 January 2019, the new bailiff law shall introduce a complaint against bailiff's actions in a new form. Analyzing the hitherto changes of this institution over the last three years, the authors put the rules of bringing in and recognizing this legal remedy in order. They also make an attempt to assess the changes. They seek an answer to the question whether the amendments implement the basic objective of accelerating enforcement and increasing its effectiveness. In the case of the last amendment, beside implementation of the indicated objectives it is also important to facilitate the procedure and increase availability of this remedy. The reflections concern changes in the jurisdiction of courts, including setting up of enforcement divisions, the consequences of introducing a complaint form and financial aspects. Concluding, the authors state that a complaint against bailiff's actions after 1 January 2019 in a new version will be a modern regulation meeting the needs of a modern society and economy.
