Abstract

The article presents the institution of so-called garden leave, which is a new one in the Polish Labour Code. The article describes what does this institution consist in and who may use it, in what circumstances, what prerequisites have to be fulfilled, whether the employee remains on payroll and whether the employer may unilaterally end the garden leave.
