Abstract
The documents and judicial practice of disciplinary courts prove beyond any reasonable doubt that when a judicial robe is taken off and the door of a barrister's chambers is closed, a member of a bar association does not cease to be a barrister (legal advisor). This is connected with the duty of proper conduct befitting the reputation of this profession of public trust. However, considering the amendments to civil procedures that have been introduced in recent years, it turns out to be an invalid and, consequently, false belief.
According to the author, a similar change concerns the issue of the duty to lodge an appeal by a professional legal agent, acting ex officio in a civil case, of the groundlessness of which he is convinced. This, to some extent, makes the regulations of the Polish Code of Civil Procedure similar to the established solutions of the penal procedure. Consequently, the issue of remunerating such legal agent for taking legal action should be reconsidered.
