Abstrakt
Projekt rozporządzenia w sprawie produktów maszynowych został ogłoszony 21.4.2021 r. równocześnie z projektem rozporządzenia ustanawiającego zharmonizowane przepisy dotyczące sztucznej inteligencji i zmieniające niektóre akty ustawodawcze Unii. Oba projektowane akty normatywne zawierają przepisy regulujące wymogi dotyczące produktów maszynowych zawierających systemy sztucznej inteligencji. Przepisy te mają na celu m.in. określenie, jakie wymagania będą miały zastosowanie w przypadkach związania produktów maszynowych z systemami sztucznej inteligencji, jak również jaka procedura oceny spełnienia tych wymagań będzie ich dotyczyć. Analiza w ramach niniejszego artykułu odnosi się zatem do wybranych wymogów, jakie muszą spełnić produkty maszynowe obejmujące systemy sztucznej inteligencji oraz procedury, w jakiej wymagania te będą oceniane w świetle projektowanych przepisów prawnych obu ww. rozporządzeń.
Abstract
Requirement with respect to machine products containing AI systems. An analysis of legal solutions planned in the law of the European Union
The article analyses the provisions of the proposal for a Regulation of the European Parliament and of the Council on machine products and the proposal for a Regulation of the European Parliament and of the Council laying down harmonised rules on artificial intelligence (Artificial Intelligence Act) and amending certain Union legislative acts from the viewpoint of regulations concerning machinery products containing AI systems. This case is specific since it contains elements that are subject to the regulations of each of the above proposals for normative acts. Thus, a question arises as to how the regulation of machinery products containing AI systems will look like. A preliminary analysis leads to a conclusion that in the case of a machinery product containing such systems applicable will be the provisions of the Regulation on machinery products concerning the requirements for these products that have been described in detail in Appendix III thereto. On the other hand, as regards AI systems as such applicable will be the provisions of the Regulation laying down harmonised rules on artificial intelligence, which is already called an Artificial Intelligence Act. The compliance of the above with the requirements for a machinery product containing an AI system will be assessed under the procedure controlled by the Regulation on machinery products.
