Prawne problemy mediów strumieniowych – o konieczności regulacji streamingu

Abstrakt
Artykuł opisuje problemy prawne, które w ostatnim czasie dotknęły nie tylko polski, ale i światowy rynek mediów strumieniowych1. Nie tylko pandemia, ale i działania samych użytkowników skłaniają do refleksji nad stanem prawodawstwa dotyczącego rozpowszechniania utworów w Internecie, w tym streamingu. Opracowanie zakreśla sfery, w których powinno nastąpić działanie ustawodawcy – przede wszystkim w zakresie kontroli i nakładania obowiązków. Ponadto artykuł wskazuje również na problemy dotyczące dostarczycieli usług streamingowych. Poza wskazaniem na konieczne działania: nowelizacje lub nowe akty prawne, opracowanie prezentuje również możliwość powołania organu edukacyjno-kontrolnego – Krajowej Rady Internetu.
Abstract
Legal problems of streaming media – the need to regulate streaming
The article describes the legal problems that have recently affected not only the Polish but also the global streaming media market. Not only the pandemic, but also the actions of the users themselves provoke reflection on the state of legislation concerning online distribution of works, including streaming. The study identifies the spheres in which the legislator should act - primarily in the field of control and imposition of obligations. In addition, the article also points out problems with respect to the streaming service providers.
