Abstrakt
Przedmiotem niniejszego artykułu jest analiza zagadnień charakterystycznych dla umów dotyczących dostarczania treści cyfrowych lub usług cyfrowych. Podstawą rozważań jest treść dyrektywy Parlamentu Europejskiego i Rady (UE) 2019/770 z 20.5.2019 r. w sprawie niektórych aspektów umów o dostarczanie treści cyfrowych i usług cyfrowych1. Zgodnie z zasadami dotyczącymi implementacji dyrektywy 2019/770, do 1.7.2021 r. państwa członkowskie miały obowiązek przyjąć i opublikować przepisy niezbędne do jej wykonania. Wejście w życie przepisów krajowych stanowiących implementację dyrektywy 2019/770 nastąpiło z mocą od 1.1.2022 r.
Abstract
A discussion of Directive 2019/770 with respect to certain aspects of contracts for the supply of digital content and digital services
The article analyses issues specific to contracts for the supply of digital content or digital services. Our considerations are based on Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services. Pursuant to the rules for the implementation of Directive 2019/770, Member States were required to adopt and publish the provisions necessary for its implementation by 1 July 2021. We consider the Directive to be progressive as the issue of digital services and content has not been standardized so far. Also in individual Member States, for instance in Poland, it has not been provided with comprehensive legal solutions. We do believe that the implementation of the Directive is undoubtedly a challenge for national legislators, who must integrate it into the existing private law system in each country.Słowa kluczowe: dyrektywa, treść cyfrowa, usługi cyfrowe, umowy, Unia EuropejskaKey words: Directive, digital content, digital services, contracts, European Union
