Wybrane prawne aspekty udostępniania i korzystania z internetowych API

Abstrakt
Ostatnie lata przyniosły dynamiczny wzrost tzw. gospodarki API. Przybywa publicznie udostępnionych w Internecie interfejsów programistycznych, umożliwiających komercyjną wymianę danych. W artykule zostały omówione niektóre problemy dotyczące udostępniania internetowych interfejsów API i korzystania z nich. Uwzględniono zagadnienia mające charakter horyzontalny, a zatem niezwiązane wyłącznie z pojedynczymi sektorami gospodarki. Wskazano na perspektywę prawa autorskiego, a ponadto zakres prawnokarnej ochrony przed nieuprawnionym dostępem do API, a także możliwości wymuszenia dostępu do danych za pomocą internetowego API.
Abstract
Selected legal aspects of the provision and use of web APIsRecent years have seen a dynamic growth of the so-called API economy. An ever-increasing number of application programming interfaces have been made available on the Internet to enable commercial exchange of data. The article discusses some of the issues related to the provision and use of web APIs. It covers issues of a horizontal nature and therefore not related exclusively to individual sectors of the economy. The issue of copyright protection of web APIs is examined, followed by the extent of criminal law protection against unauthorized access to a web API, as well as the possibility of forcing access to data via a web API.Słowa kluczowe: API, gospodarka API, interfejsy programistyczneKey words: API, API economy, programming interfaces
