Abstrakt

Artykuł dotyczy problematyki monitorowania pracowników. Autor analizuje wprowadzone w maju 2018 r. do KP zmiany oraz orzecznictwo ETPCz. Oprócz wykładni nowo wprowadzonych przepisów, w artykule podjęto próbę określenia granic monitoringu.


Summary:

Monitoring at work after amendment of the Labour CodeThe article analyses the issue of monitoring employees in light of changes made in the Labour Code in 2018 and the ECtHR jurisprudence under Art. 8 of the ECHR. The author approves of the decision to regulate monitoring in the Polish labour law, although some of the regulations raise doubts, especially those indicating the purposes of monitoring. The new regulations are also relatively general, which would require taking into account GDPR regulations as well as the jurisprudence of the ECtHR and the Polish Supreme Court. It also should be underlined that the Polish regulations do not allow for secret monitoring.Key words: monitoring at work, personal data protection, privacy at work
