Ustalenie winy jako przesłanka uwzględnienia zadośćuczynienia za naruszenie dóbr osobistych

Abstrakt
Uwzględnienie zadośćuczynienia w oparciu o treść art. 448 KC wymaga nie tylko ustalenia bezprawności zachowania sprawcy, lecz także jego winy, określanej subiektywną przesłanką odpowiedzialności. Chodzi o podmiotową niewłaściwość postępowania, ponieważ oceniane jest zachowanie szkodzące wyłącznie z uwagi na cechy podmiotowe sprawcy. Judykatura i doktryna dość powszechnie przyjmują tzw. normatywną koncepcję winy, uznającą winę za ujemną ocenę zachowania podmiotu, umożliwiającą postawienie mu zarzutu podjęcia niewłaściwej decyzji w danej sytuacji.

Summary:
Determination of guilt as a prerequisite for compensation awarded for infringement of personal rights
When the prerequisites for enforced admission to a psychiatric hospital have been met, despite obvious infringement of a patient’s personal rights it is a lawful action and in consequence there are no legal grounds for awarding compensation. Admission under Art. 24.1 of the Mental Health Act structurally assumes the uncertainty of a diagnosis and hospital observation is meant to clarify all doubts concerning the nature of mental disorders. Contrary to what is claimed by the Appeal Court, Art. 448 of the Civil Code is based on the principle of guilt and may be applicable under any regime of tortious liability. The rigid stance of the judicature that the court considering a compensation claim for unjustified hospitalization in a mental institution without consent is bound under Art. 365 of the Code of Civil Procedure by the decision of a guardianship court (confirming that unjustness) may lead to a violation of the material truth principle (Art. 3 of the Code of Civil Procedure).
