On the overlap of grounds for rejecting a tender: where the content conflicts with procurement documents and the price is abnormally low given the subject of the order

Abstract

The article examines how two grounds for rejecting a bid can apply simultaneously in relation to the same required element of performance, as set out in Article 226 section 1, points 5 and 8 of the Public Procurement Law. The study is prompted by the common practice of contractors raising such objections at the same time in appeal proceedings.
