Legal aspects of electromobility in light of the CJEU judgment of 20 March 2025 (C-480/23, Bulgaria)

Abstract

Electromobility consists of using cars and other vehicles powered by electricity (not fossil fuels). This covers not only the vehicles themselves (cars, trucks and buses), but also the equipment that makes up the charging infrastructure, the production of means of transport and other items, energy consumption, and various social and environmental aspects.
Under the provisions of Directive (EU) 2019/1161 of the European Parliament and of the Council of 20 June 2019 amending Directive 2009/33/EC on the promotion of clean and energy-efficient road transport vehicles (the “Directive”), Member States were required to enact the laws, regulations and administrative provisions necessary to comply with the provisions of that Directive by 2 August 2021 at the latest. The Republic of Bulgaria failed to fulfil its obligations as a Member State, and the European Commission therefore initiated proceedings against it, resulting in the imposition of a penalty for failing to meet its obligations to transpose EU legislation into national law.
