Contract modification in public procurement in the context of official audit results and case law

Abstract

The need to protect the outcome of a public procurement procedure means that the Public Procurement Law must also cover certain aspects of the execution phase of a public procurement contract. A key instrument within this regulation is the provision governing the admissibility of modifying a public procurement contract. Polish law grants the President of the Public Procurement Office the authority to seek the annulment of an unlawful amendment to a public procurement contract. The president files this action after conducting an inspection pursuant to Article 607 et seq. of the Public Procurement Law. This paper analyses the results and outcomes of such inspections.
