Abstract

This glossary relates to the judgment of the Court of Appeal, pointing to important civil law issues related to joint and several liability of the general contractor and the investor for the obligations towards the subcontractor. It indicates both the formal and legal conditions related to the effective notification of the subcontractor and the effective notification of the investor’s objection. It is necessary to emphasize issues related to the term, form, content and scope of both the notification and the contradiction. In addition, issues related to the relationship between the provisions of the public procurement law and the Civil Code, as well as the impact of withdrawal from the contract with the general contractor or subcontractor on the previously established joint and several liability of the investor and the general towards the subcontractor were discussed.
