Abstract
The purpose of the study is to demonstrate the environmental elements that should be considered at the stage of preparation of documentation preceding the issuance of a construction permit and to identify and characterise the public procurement instrument by means of which the contracting authority may analyse environmental issues. The study analyses the provisions of the new executive regulation to the Public Procurement Law and the provisions of this law in terms of effective preparation of a public procurement. The thesis is that the contracting authority should use the needs and requirements analysis, regulated in Article 83 of the Public Procurement Law, to prepare design documentation for construction works that takes environmental aspects into account, which will have a positive impact on the efficiency of the procurement.
