Abstract
The aim of this study is to present the results of research conducted by the authors concerning a complaint brought against the decision of the National Appeals Chamber in light of the case law of the Lower Silesian courts in 2015–2019. The research carried out by the team shows that, in the period 2015–2019, public procurement cases accounted for only 0.1% of appeal cases (civil and commercial) in the courts of Lower Silesia, which proves their incidental nature. The quantitative analysis of the presented statistical data shows a very low level of appeal against the judgments of the National Appeal Chamber to regional courts, less than 6% on a national scale (which may indicate that parties tend to accept the NAC’s decisions). The aim of this paper is to analyse the previous mechanism and – using statistical data – determine its effectiveness.
