New qualification procedure for members of the National Appeals Chamber

Abstract

The paper presents changes concerning the requirements for candidates wanting to become members of the National Appeals Chamber, and the regulations on how candidates are qualified to become members of the National Appeals Chamber, which were introduced to the appeals procedure under the Public Procurement Law of 11 September 2019. The new Public Procurement Law introduced several significant changes related to the qualification requirements for candidates for members of the National Appeals Chamber, and their appointment to this Chamber. The regulation currently in force, which sets out the detailed scope of issues based on which the selection procedure is conducted, as well as the procedure and method of appointing the selection committee, detailed requirements for members of the selection committee and the organisation of its work, will also probably be amended. Therefore, some conclusions de lege ferenda were pointed out, suggesting the need to change the criteria by which written work and the interview are assessed, and to modify the elements being assessed under these criteria.
