Abstract
The author is seeking to answer the question as to whether, what extent and on what basis the terms of participation in proceedings apply at the stage of performing the contract. As a rule, the terms and conditions of participating in proceedings do not apply at the stage of performing the contract unless the contracting authority introduces the relevant provisions in the contract. The need to do this depends to a large extent on the nature of the subjective properties to which a certain condition for participation in the proceedings applies. Permanent properties do not need to be secured by contractual provisions, as opposed to ad-hoc properties, which are more likely to be overlooked at the contract execution stage.
