Abstract

Every contracting authority is free to assess the circumstances of a particular case that may give grounds to exclude a contractor from the procedure, and thus to decide for itself whether, in its opinion, the contractor is reliable and credible. This right constitutes the implementation of the principle of proportionality, which must be applied in full when deciding on any optional grounds for the exclusion of a contractor.
