The amendment of the Polish Public-Private Partnership Act in light of the benchmark of public-private cooperation set out in the World Bank’s 2018 Report on Procuring Infrastructure Public-Private Partnerships

Abstract

Amendments to the Polish Public-Private Partnership Act were adopted in August of this year, introducing many new legal solutions to the domestic legal system. Among other things, there are new provisions connected with the preparation and implementation phase of projects, the elimination of unsolicited proposals and the introduction of a step-in rights solution. The new Polish regulation complies with the recommendations set out in the World Bank Report on Procuring Infrastructure Public-Private Partnerships issued in June of this year. As a result, the Polish regulation is modern and should work properly in practice. At the same time, it is also vital to develop and strengthen good governance and good practices in Polish public administration.
