Abstract
The 2016 amendment of the PPA affects decisions of the NAC with respect to all stages of public procurement proceedings. The article identifies the Report on the NAC activity in 2016 as a fundamental document reflecting current trends and decisional dilemmas in connection with the implementation of new public procurement directives in the national system. The article points out greater importance of evidentiary proceedings in a large measure being an effect of the stability of NAC’s decisions. The problem of exclusion of a dishonest contractor and awarding an in-house contract have been presented in detail. The article presents issues concerning evidentiary proceedings with respect to challenging the selection of the best offer in lower value contracting proceedings and the wording of the substantiation of a decision in connection with the new possibility to accept or reject some of the charges raised in the appeal.
