How not to use the AI Act based on the definition of an artificial intelligence system

Abstract

The article is devoted to the possibilities offered by the definition of an artificial intelligence system comprised in the AI Act. This definition implies that an artificial intelligence system must be able to learn after implementation. If after the deployment of an artificial intelligence system the possibility of learning is blocked therein, such a system shall not be covered by the definition. Such a system may be used, but since it is not an artificial intelligence system within the meaning of the definition provided for in the AI Act, its use is not associated with the obligations that are associated with the use of an artificial intelligence system consistent with the definition.
The article also proposes a definition of artificial intelligence based on the definition of an artificial intelligence system.
