Abstract

The digital services act introduced in its Section 4 the obligations addressed to providers of online platforms allowing consumers to conclude distance contracts with traders. In addition to setting out the standard of due diligence for providers of intermediary services, the obligations reflect the EU legislator’s approach to the role of providers of online platforms and the evolution it has undergone since the adoption of Directive 2000/31 on electronic commerce. Article 31 - Compliance by design, i.e. the obligation to design and organize interfaces in a way that allows the recipients of the service to comply with their legal obligations - introduces new obligations regarding the content of service recipients. The article describes the components of compliance by design and practical doubts related to the implementation of the provisions of this article.
