Where the DSM gets tough, the DSA will help, i.e. about the mutual relationship of Art. 17 DSM and the Digital Services Act

Abstract

Article 17 of the Directive on copyright and related rights in the Digital Single Market introduced a complex mechanism of liability for copyright infringement for certain hosting service providers - online content-sharing service providers. With regard to the regulated matter, it seems that the mechanism outlined there will interact with the provisions of the Digital Services Act. This article is therefore devoted to the relationship between these provisions, which may complement each other and thus lead to greater harmonisation and legal certainty for hosting service providers in the European Union.
