Abstract

The article presents the consequences of the declaration of bankruptcy of a party to a lease agreement and a tenancy agreement. The bankruptcy law provides for a departure from the “individual” principles for the performance of the bankrupt’s obligations. As a rule, after the declaration of bankruptcy, further performance of those obligations may take place only according to the legal regulation laid down in the bankruptcy law, i.e. taking into account collective determination and satisfaction of the claims of the bankrupt’s creditors. The article discusses the issue of further performance of the lease and tenancy agreements with the participation of the receiver and the possibility to terminate such agreements.
