Abstract

The author has presented different theories of the consequences of faulty joint representation. Theissue is subject to a vigorous discussion among representatives of the doctrine and has not been statutorily resolved so far. It generates numerous divergences in legal practice. In the author’s opinion the concept presented by M. Wojewoda arousesa number of practical doubts and is not based on clearly defined premises.
