Security for disputable claims in the course of liquidation of a limited liability compa-ny

Abstract

Under the liquidation proceedings of a limited liability company priority is given to satisfying the interests of its creditors. Upon opening of the liquidation proceedings, as opposed to the declaration of ban-kruptcy, all claims against the company do not become immediately due and payable. Hence, one of the duties imposed on the liquidator is to place funds in a court deposit for the satisfaction of not matured or disputable claims. The authors analyse the usefulness of the institution of a court deposit and discuss issues concerning admissibility and legal effects of the completion of the liquidation proceedings under which funds have been placed in a court deposit.
