Abstract

Personal rights and claims constitute a special legal institution which is not defined in the legal system.

Disclosure of personal rights and claims in the land and mortgage register significantly expands legal protection of interests of persons in whom those rights or claims are vested.

The article constitutes a compendium of knowledge concerning personal rights and claims, and because of its size it has been divided into two parts.

In the first part, the Author presents the notion, origin, classification and disclosure of personal rights and claims in the land and mortgage register and their assertion under enforcement proceedings. In the second part, to be published in MPH No. 2/2012, the Author will analyze assertion of personal rights and claims under bankruptcy proceedings.
