Abstract
The publication contains an analysis of Art.1831 of the Commercial Companies Code, which provides that the articles of association may limit or exclude joining of a company by the spouse of a shareholder where the share or shares are part of the joint marital property, and Art. 3321 of the Commercial Companies Code, according to which the statutes may provide that where registered shares are part of the joint marital property, only one of the spouses may be a shareholder.
