On the necessity to change the regulations regarding transmission in succession law

Abstract

The purpose of the article is to analyze the effective regulations of succession law regarding the transmission of the right to submit a declaration of acceptance or rejection of the inheritance. The authors notice the incompleteness of the regulations, especially within the legal nature of the transferee acquiring the powers of the transmitting heir, the beginning of the period to submit a declaration by the transferee and the consequences of multiple transferees. The article discusses the most important concepts created in the doctrine of civil law together with their practical consequences. Deliberations point to identification of interpretative and procedural difficulties that influence the length and effectiveness of succession proceedings. Dilatations of the authors lead to a firm conclusion - the necessity of a legislative intervention allowing a clarification of transmission regulations in the Civil Code.
