Abstract
The article delves into the intricacies surrounding the allocation of the burden of proof in judicial proceedings concerning claims against members of the management board of a limited liability company for the company’s obligations. It further explores the issues pertaining to the ongoing dispute regarding the nature of the liability of members of the management board within the framework of a limited liability company. The paper also examines the implications of bankruptcy law regarding the aforementioned issues. Additionally, it outlines the prevailing procedural pitfalls associated with the apportionment of the burden of proof across diverse procedural configurations.
