Proportional allocation of court costs in medical compensation cases

Abstract
Proportional allocation of court costs remains the most common method of distributing court costs adjudicated in medical compensation cases. This approach may seem transparent and fair; however, in the absence of standardized criteria for determining the amount of compensation, should the plaintiff be charged based on their fulfilment? Would it not be more appropriate to make the fee “independent” from the amount of claim, so that the plaintiff does not feel compelled to limit their claim for fear that it could be reduced by proportionally allocated court costs? The article attempts to address these questions and explore the possibility of finding aurea mediocritas.
