Abstract

The article discusses the discrepancy in the doctrine and case law regarding the application of Art. 115 of the Civil Code to limitation periods. Two views have been developed in this regard. In accordance with the first one, Art. 115 of the Civil Code does not apply to the calculation of the limitation period, which means that in a situation whereby the last day of the limitation period falls on a Saturday or a day off work, the creditor still cannot claim or take other actions on the next business day under Art. 123 § 1.1 of the Civil Code with the effect of interrupting the limitation period. The opposite view, on the other hand, allows for such a possibility and advocates the application of Art. 115 of the Civil Code to the limitation period. The Supreme Court adopted the latter in its judgment of 14 February 2025, II CSKP 1946/22.
