Adjudication at an in camera session by common courts in civil lawsuits - theory and practice

Abstract

The article presents the possibility of passing a verdict at an in camera session in civil lawsuits by common courts of first and second instance in Poland. Discussed are the cases of issuing a judgment when the defendant recognized the claim and it is not necessary to conduct the proceedings (before the court of first and second instance), when the proceedings were closed at an in camera session, when the court dismisses the action which is manifestly groundless (and when it hears an appeal against such a verdict) and when the court issues a judgment by default. The theoretical remarks concerning the indicated procedural institutions have been supplemented with reflections on the practical aspects of their application in civil lawsuits, in particular in the context of the right of a party to open and efficient examination of their case.
