Abstract

The article presents an introduction to the new regulation establishing additional procedural rules for the enforcement of the GDPR in cases of cross-border processing of personal data. The regulation supports the One Stop Shop (OSS) mechanism by harmonising procedures, which is intended to contribute to more effective cooperation between national data protection authorities. The main goals of the regulation are: to simplify cooperation and shorten the duration of proceedings, to harmonise complaint procedures and to clarify the procedural rights of parties as well as the position of the complainant in cross-border proceedings. While not changing the role of key actors or other elements of the GDPR, the regulation ensures transparency in the rules of cooperation and timing between data protection authorities and proposes specific solutions to support early consensus. The document also addresses the rights of complainants and parties to the proceedings, defining their procedural rights and appeal options.
