Abstract
The study is a commentary on the CJEU judgment of 4 October 2024 in case C-21/23 (Lindenapotheke) regarding one of the two main issues that are the subject of the ruling - interpretation of the concept of “health data”. The initial part presents the facts, and then discussed are: the decisions of national courts and requests for a preliminary ruling, the opinion of the Advocate General and the CJEU judgment. The following sections provide the analyses relating to the interpretation of the concept of “health data” and some critical remarks on the commented judgment, as well as its consequences.
