The essence and limits of the right to an explanation of the decision-making procedure in an individual case under the AIAct

Abstract

The article examines the right to obtain an explanation of the decision-making procedure in individual cases, as provided for in Article 86 of the AIAct, which introduces a new safeguard for individuals affected by automated decision-making processes. The analysis focuses on the conditions for exercising this right, particularly the scope of the notion of an „affected person,” the nature and content of decisions based on the output of high-risk AI systems, and the role of the user as the addressee of explanation requests. It also discusses the standards and practical challenges of providing explanations, the lack of sanctions for non-compliance, and the potential exemptions and limitations established in the regulation. Special attention is given to the relationship between Article 86 AIAct and Article 15(1)(h) GDPR, highlighting the risk of overlapping information rights
