Abstract

The article discusses liability for illegal tapping of energy under Art. 57.1 of the Energy Law seen from the viewpoint of the constitutional principle of equality. The analysis embraces both the specific, risk-based, nature of that liability, as well as assessment of the issue in light of three different planes of relationships: 1) energy company vs. its clients, 2) energy company vs. other entrepreneurs, and 3) clients of energy companies vs. clients of other network network sector companies.
