Definition of a trade secret according to Directive 2016/943 and its implementation to national legal orders on the example of Germany and Poland

LL.M. Autorka jest absolwentką kierunku „Magister des Rechts”, prowadzonego wspólnie przez WPiA Uniwersytetu im. Adama Mickiewicza w Poznaniu oraz Wydział Prawa Uniwersytetu Europejskiego Viadrina we Frankfurcie nad Odrą, a także kierunków „Bachelor of German and Polish Law” i „Master of German and Polish Law” na Wydziale Prawa Uniwersytetu Europejskiego Viadrina we Frankfurcie nad Odrą. Obecnie przygotowuje rozprawę doktorską na WPiA Uniwersytetu im. Adama Mickiewicza w Poznaniu.
Autor jest absolwentem WPiA Uniwersytetu Warszawskiego oraz Szkoły Prawa Amerykańskiego WPiA Uniwersytetu Warszawskiego oraz University of Florida. Obecnie przygotowuje rozprawę doktorską w Instytucie Prawa Cywilnego Uniwersytetu Warszawskiego oraz pracuje jako prawnik w BSH Sprzęt Gospodarstwa Domowego Sp. z o.o. w Warszawie.
Abstract
The article analyses the current wording of the definition of trade secret in the legal systems of Germany and Poland, as well as of the manner of implementation of Directive (EU) 2016/943 of the European Parliament and of the Council of 8 June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure. Furthermore, the article presents the main assumptions and objectives of Directive 2016/943 itself.
