Disposal of perpetual usufruct and the obligation to pay the annual charge in light of Art. 71.7 of the Real Property Management Act

Abstract

The act of disposal of perpetual usufruct does not affect the entity that is the debtor for the annual fee. Even if the act of disposal took place before 23 August 2017 (when the new regulations came into force), the obligation to pay the annual charge fall on the entity that was perpetual usufructuary on 1 January of that year.
