Abstract

The article discusses the issue of so-called “fruits of a poisonous tree”, that is evidence obtained against the law or the principles of social coexistence. Otherwise than in the criminal and administrative procedure, the provisions of the Code of Civil Procedure do not contain any regulations referring to such evidence. This gap is filled by jurisdiction and, basing on its analysis, it is possible to reach some general conclusions as to the prerequisites for accepting such evidence.
